Terms and Conditions

 

 1.       Your Instructor and Elite.

 

1.1               By using the term “we” or “us” we are referring to Elite Driving School, “our” or their” refers to Elite Franchised Instructors.

1.2               Elite Driving School acts as an agent for its franchised instructors. We take bookings on behalf of our instructors it’s their responsibility to arrange all further bookings with the customer.

1.3               Elite Driving School acts as agent for your instructor in receiving your payments for driving tuition other than payments made directly by you to your instructor. See section 6

1.4               Where Elite makes bookings with you, or supplies any information or documentation to you, or processes any payments for your lessons, they act as an agent for their franchised instructors.

1.5               Once the driving school has processed your booking, they hand over the contract for your driving tuition to your allocated franchised driving instructor, who will be solely responsible for providing you with a service.

 

2.       Tuition

 

Tuition is only available to persons who meet the following criteria.

 

2.1               Aged 17 or over or aged 16 or over and in receipt of the higher rate of Disability Living Allowance (mobility component)

2.2               Hold a valid UK provisional driving licence

2.3               Legally entitled to drive in the UK

2.4               You must inform us of any endorsements and if you have been banned from driving at any time, which may affect our insurance.

 

3.       Lessons

 

3.1               You and your instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.

You must notify your instructor of any matters which affect your ability or entitlement to have driving tuition, for example the loss of a valid UK provisional driving licence or any medication that may affect your ability to drive a vehicle.

3.2               Your Instructor has a right to terminate your lesson should he or she feel that you are unfit to drive due to the use of alcohol or drugs.

3.3               It is your responsibility to bring your Elite Track Record book to all your lessons.

 

4.       Cancellation of Lessons

 

4.1         If you need to cancel a lesson a minimum of 48 hours’ prior notification should be given, this allows your instructor time to offer that space to other customers. Because your instructor is a self-employed franchisee of the driving school, when you book a lesson with them you have taken that time out of their diary and agreed payment for that time. Should you cancel that lesson at short notice your instructor does not get paid for that time, and they have the right to charge you for it.

4.2          Your cancellation must be made direct to your instructor. He or she will require you send them a text message within 48 hours, with a message left on their voicemail for confirmation. Alternatively, you can call the driving school office between 9am to 5pm Monday to Thursday and 9am to 4pm Friday. Please note the office is closed Saturday, Sunday and bank holidays.

4.3               Please make sure when calling the office, you inform them of your instructor’s name, date and time of your lesson. Failure to do so may result in the lesson being charged for.

4.4               Failure to give 48 hours’ notice may result in part or all of the lesson price being charged by the instructor.

 

5.       Payments made through Elite driving school

5.1               Payment by credit or debit card made through Elite’s office are subject to a 2% handling fee and will be transferred to your franchised driving instructor.

5.2               Payment by credit or debit card or by validating an Elite Gift Voucher should be made by telephoning the Elite office, we are in managed offices and security of other offices prevents us from allowing visitors on to the premises.

5.3               Bank transfers can be paid online directly into Elite driving schools Customer holding account and will be transferred to your franchised driving instructor.

5.4               Please note gift vouchers are valid until the expiry date shown thereon.

Gift vouchers have no cash value and have to be redeemed against tuition.

5.5               Payments made directly through the Elite booking office will be paid directly to your instructor upon the start of your driving lessons with them.

5.6               Elite has no responsibility or liability to you for payments made by any other means. If you pay your instructor directly by any method, you should obtain a receipt. Elite accepts no responsibility for any payments made directly to instructors.

 

6.       Payments made directly to Elite Franchised Driving Instructors

6.1               Please note that your driving instructor is a self-employed professional and operates a franchise with Elite Driving School.

 

6.2               Payments made directly to an Elite instructor which do not pass through the driving school are NOT the responsibility of Elite Driving School.

 

6.3               Should a dispute arise or a refund be requested you must arrange this with your driving instructor.

 

6.4               The terms of payment are an agreement directly between the customer and the Elite Franchised Driving Instructor and are therefore not subject to the terms of the driving school.

 

6.5               If a dispute should arise over payments and or a refund be requested and the customer not be satisfied with the arrangement made by their Elite Franchised Instructor, they can request that Elite Driving School investigate the matter and advise accordingly.

 

 

7.       Special Offers and Discounts

6.1.      Elite presents a great range of offers and discounts to new and existing learner pupils on learning to drive and other related products.

6.2       Elite reserve the right to change or withdraw special offers without notice.

6.3       Introductory offers are subject to availability and may only made available to new learner pupils of the driving school and it’s franchised instructors and.

6.4       Offers are subject to the discretion of the customer service staff and cannot be used in conjunction with other offers and are not transferable.

 

9.         Transferability of Lessons

 

You cannot sell or transfer lessons which have been purchased in your name to any other person.

 

10.       Refunds

10.1     You are entitled to cancel your prepaid tuition at any time (for the provisions relating to the cancellation of individual lessons please see the “Cancellation of Lessons” in section 4. If you have not taken any lesson(s) at the time of cancellation you will be entitled to a full refund of any amount paid to Elite, subject to the 48 hours’ cancellation notice and to the terms below (not applicable to intensive driving courses).

10.2.   If you have taken lesson(s) at the time of cancellation. You will not be eligible for a refund on any lessons taken.

10.3.   Where it is possible to do so, we will refund you using the same method you used to pay for your lessons when you made the payment. If for any reason we are unable to do this, we reserve the right to refund you by any other method we deem appropriate.

10.4     We may request additional information from you to confirm your identity in order to comply with the Money Laundering Regulations 2007; we will also use this information to ensure adherence to our Merchant Operating Instruction for card collection facilities.

10.5     Refunds may take up to 10 working days to reach you or your account.

10.6     Refunds for “Try Us” Offers will be made pro rata on any lessons not taken.

10.7     In the event of a “Buy one get one free” offer, no refund will take place once the first lesson has been taken.

10.8     Refunds on block bookings any unused training time will be recalculated at the normal lesson rate and the remainder refunded accordingly.

10.9     Refund Procedure: 

  • Contact your instructor within 24 hours of your lesson to explain your concerns over the service or the tuition that you received. He/she will calculate the refund with you.
  • If you are not satisfied with the outcome of the conversation with your driving instructor then contact Elite Driving School
  • Give the name of your driving instructor along with the lesson time and date.
  • Explain the full details as to why you were not satisfied with either the service or the tuition you received.

*Refunds do not apply to cancelled lessons or to lessons on test day.

11.       Intensive Course & Route 66 driving course Payments and Refunds.

 

11.1     To book a Route 66 Driving Course payment must be received 14 days prior to the commencement of the first lesson. Refunds for any unused training will be recalculated at the normal lesson rate and the remainder refunded accordingly. For cancellation of lessons our 48 hours’ notice period is required.

11.2     For Intensive Driving Courses over a duration of 1-3 weeks a £100 deposit will be required to book a course with the balance due 14 days prior to the commencement of the course. If the course is cancelled within 4 weeks of the commencement date the deposit will not be refunded. If the course is cancelled within the two-week period prior to the commencement date only 50% of the entire course cost will be refunded. If the course is cancelled after commencement no refund will be issued.

11.3     Intensive driving courses: If your driving test is cancelled by the DVSA within 14 days prior to the commencement of your course only 50% of the entire course cost will be refunded. If the course is cancelled after commencement no refund will be issued. Please note: When booking an intensive course you are booking that time out of an instructor's diary and agreeing to pay for that time. We are not responsible for the DVSA cancelling driving tests, the agreement for your test is between you and them, the agreement for your lessons is between you and Elite Driving School or our franchised instructors..

11.4     Lessons cancelled at short notice or missed for whatever reason during an intensive course will not be refunded or rearranged.

11.5     Driving course itinerary. Once a driving course is booked and confirmed between both parties we will not be able to change any of the agreed days or times. Should you need to change your location you must inform your instructor within 24 hours. He or she may not be able to agree to the new pickup location if it means that it will disrupt the rest of their day.

 

12.       Failure to Show for Pre-Arranged Driving Lessons.

 

If your instructor arrives for a pre-arranged lesson and you are not at the agreed pick up location, he/she will make every attempt to get in touch with you and offer you the remainder of the lesson time if you can get yourself to the arranged pick up location. They will be available for 15 minutes at the agreed pick up location before terminating the lesson, then the full lesson time will not be credited or refunded.

 

13.       Practical Driving Test

13.1     If you or someone other than your instructor or the driving school books a driving test, your driving instructor reserves the right to withhold the driving school car for the practical test should they not be available.

13.2     Your driving instructor reserves the right to withhold the driving school car for a practical test if in their opinion the chances of passing the test are unrealistic, or if you pose a danger to the examiner or any other road user.

13.3     It is your responsibility to bring the correct documents as required by the DVSA with you on the day of your driving test.

13.4     It is your responsibility to make sure that you give your driving instructor the correct day, time and test centre of your test booking.

13.5     In the event of the driving school car being unavailable on the day of the practical test for reasons of illness on your instructor’s part, or for reasons of mechanical failure, your instructor will refund test fees incurred by you in full plus the pre-test hours.

13.6     In the event of the practical test being cancelled by the DVSA it is normal practice for the test fee to be refunded by them, however lessons booked on the day will be subject to the 48 hours’ late notice cancellation and will require payment (some of these fees can normally be claimed back from the D.S.A).

13.7     In the event that a driving test has been booked for you by your instructor or Elite Driving School, Elite or our Instructors are not responsible should the DVSA cancel that test and no refunds for the test or lessons will be issued by us or our instructors.

13.8     Please note that in the event of you booking your driving test the DVSA stipulates that you need to give 3 clear working days to cancel your test, failure to do so will result in the loss of your fee.

13.9     You must have your instructor’s agreement to book a driving test otherwise the driving school vehicle will not be made available to you.

 

14.       Price Changes

 

14.1     The cost of prepaid tuition is based on the lesson price in force at the time of booking and with the exception of the circumstances set out below, will be honoured for 12 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 12 months have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by you.

14.2     Circumstances where, if you have prepaid you will be either required to pay an additional amount beyond the cost of your prepaid lessons or receive a partial refund of some of your prepayments (as applicable).

14.3     Where you have moved postcode area and requested reallocation to another instructor because your current instructor does not operate in the new postcode area, you will be required to cover any difference in the hourly rate between those instructors where your new instructor charges a higher hourly rate or where your instructor charges a lower rate, you will be refunded the difference.

14.4     Where you have requested to switch instructors within the same postcode area and your new instructor charges a higher hourly rate than your previous instructor. You will be required to pay the difference in the hourly rate or where your instructor charges a lower rate, receive a refund of the difference.

14.5     Where you have requested to switch instructors in the same postcode area and your new instructor charges a supplement (for example an additional fee for tuition in a car with automatic transmission), you will be required to pay any such supplement.

14.6     Where you have not undertaken any lessons for a period of three months and have been reallocated an instructor after a price rise in tuition has taken place. You will be required to pay the difference in price for your remaining lessons.

 

15.       Limitation of Liability

 

15.1     Your Instructor and/or Elite shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.

15.2     Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.

15.3     These terms and conditions are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the English Courts.

 

16.       Insurance

 

Your instructor will carry the appropriate motor insurance should you be involved in a collision as a learner driver whilst in control of driving the instructor’s tuition vehicle.

 

17.       Complaints Procedure

 

If you have any concerns or complaints about any part of your driving tuition, please bring it to the attention of your driving instructor and they will endeavour to address the situation. If the event that you are not satisfied you may make reference to the register of approved driving instructors who will consider the matter and advise accordingly. In the event that your complaint cannot be resolved please put it in writing to Elite Driving School Instructor Franchise at The Hall, Packman Lane, Kirk Ella, HU10 7TJ we will try to resolve all issues within 10 working days of receipt.

 

18.       Customer Care

 

18.1     Your contract is between you and your instructor. In the rare event of any problem arising you should resolve this with your instructor immediately. We recommend no further lessons are taken until the matter is resolved.

18.2     In the unlikely event that you are unable to reach a satisfactory conclusion, we will be happy to investigate further until the matter is resolved. Please note that we will require evidence of any financial transactions and lessons times before we are able to investigate.

18.3     It is imperative that your Driver Record (provided to you by your instructor) details are kept accurate and up to date.

18.4     If you still feel dissatisfied, you may contact the Driver and Vehicle Standards Agency on 0300 200 1122 who may be able to help you further.

 

19.       Collection and Use of Data

 

19.1     Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998.

19.2     We will use your personal data for the purpose(s) for which you have provided it. It may also be used for marketing, research and statistical purposes and crime prevention.

19.3     We may however need to disclose personal data to a third party so that the service you requested could be provided. It may also be necessary to transfer it to countries outside the European Economic Area. Where this happens, we will endeavour to ensure that any recipient of your data will treat it with the same level of protection as we would.

19.4     Your data may be disclosed to regulatory bodies for the purposes of monitoring and/or enforcing compliance with any regulatory rules/codes.

19.5     If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to be able to process their personal data (including any sensitive personal data) and also that you have told them who we are and what we will use their data for, as set out in this notice.

19.6     By providing us with your personal data and contact details, you consent to allowing Elite to contact you by post, telephone, email, SMS or other electronic means to inform you about products and services which it considers may be of interest to you.

19.7     Your calls to the Customer Service Centre may be recorded for quality monitoring and training purposes.

 

20. Money back Guarantee

20.1 Try us offers: Should you feel that we have not lived up to your expectations with either the service we offer or the quality of the tuition you can request a full refund for any unused lessons. Refunds are pro-rata

20.2 Route 66 driving courses: If you book more hours than required and you manage to pass your driving test before all your paid course hours have been used, your instructor will refund any unused course hours at the rate of the course you are on.

Any unused lessons remaining after 12 months have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by you.

14.2     Circumstances where, if you have prepaid you will be either required to pay an additional amount beyond the cost of your prepaid lessons or receive a partial refund of some of your prepayments (as applicable).

14.3     Where you have moved postcode area and requested reallocation to another instructor because your current instructor does not operate in the new postcode area, you will be required to cover any difference in the hourly rate between those instructors where your new instructor charges a higher hourly rate or where your instructor charges a lower rate, you will be refunded the difference.

14.4     Where you have requested to switch instructors within the same postcode area and your new instructor charges a higher hourly rate than your previous instructor. You will be required to pay the difference in the hourly rate or where your instructor charges a lower rate, receive a refund of the difference.

14.5     Where you have requested to switch instructors in the same postcode area and your new instructor charges a supplement (for example an additional fee for tuition in a car with automatic transmission), you will be required to pay any such supplement.

14.6     Where you have not undertaken any lessons for a period of three months and have been reallocated an instructor after a price rise in tuition has taken place. You will be required to pay the difference in price for your remaining lessons.

 

15.       Limitation of Liability

 

15.1     Your Instructor and/or Elite shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.

15.2     Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.

15.3     These terms and conditions are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the English Courts.

 

16.       Insurance

 

Your instructor will carry the appropriate motor insurance should you be involved in a collision as a learner driver whilst in control of driving the instructor’s tuition vehicle.

 

17.       Complaints Procedure

 

If you have any concerns or complaints about any part of your driving tuition, please bring it to the attention of your driving instructor and they will endeavour to address the situation. If the event that you are not satisfied you may make reference to the register of approved driving instructors who will consider the matter and advise accordingly. In the event that your complaint cannot be resolved please put it in writing to Elite Driving School Instructor Franchise at The Hall, Packman Lane, Kirk Ella, HU10 7TJ we will try to resolve all issues within 10 working days of receipt.

 

18.       Customer Care

 

18.1     Your contract is between you and your instructor. In the rare event of any problem arising you should resolve this with your instructor immediately. We recommend no further lessons are taken until the matter is resolved.

18.2     In the unlikely event that you are unable to reach a satisfactory conclusion, we will be happy to investigate further until the matter is resolved. Please note that we will require evidence of any financial transactions and lessons times before we are able to investigate.

18.3     It is imperative that your Driver Record (provided to you by your instructor) details are kept accurate and up to date.

18.4     If you still feel dissatisfied, you may contact the Driver and Vehicle Standards Agency on 0300 200 1122 who may be able to help you further.

 

19.       Collection and Use of Data

 

19.1     Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998.

19.2     We will use your personal data for the purpose(s) for which you have provided it. It may also be used for marketing, research and statistical purposes and crime prevention.

19.3     We may however need to disclose personal data to a third party so that the service you requested could be provided. It may also be necessary to transfer it to countries outside the European Economic Area. Where this happens, we will endeavour to ensure that any recipient of your data will treat it with the same level of protection as we would.

19.4     Your data may be disclosed to regulatory bodies for the purposes of monitoring and/or enforcing compliance with any regulatory rules/codes.

19.5     If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to be able to process their personal data (including any sensitive personal data) and also that you have told them who we are and what we will use their data for, as set out in this notice.

19.6     By providing us with your personal data and contact details, you consent to allowing Elite to contact you by post, telephone, email, SMS or other electronic means to inform you about products and services which it considers may be of interest to you.

19.7     Your calls to the Customer Service Centre may be recorded for quality monitoring and training purposes.

 

20. Money back Guarantee

20.1 Try us offers: Should you feel that we have not lived up to your expectations with either the service we offer or the quality of the tuition you can request a full refund for any unused lessons. Refunds are pro-rata

20.2 Route 66 driving courses: If you book more hours than required and you manage to pass your driving test before all your paid course hours have been used, your instructor will refund any unused course hours at the rate of the course you are on.
